Moving In The Right Direction

A Delivered2Choices supervisor shakes hands with a flagger on a construction site. A 'Final SAP Report' and other trade workers (linemen) are visible, reinforcing non-DOT return-to-duty clearance.

Navigating the Non-DOT Return-to-Duty Process for Union Trades, Linemen, and Construction Workers

Do you work in the trades? A workplace drug or alcohol violation can quickly halt your livelihood. This applies to linemen, electricians, flaggers, and construction workers. It also affects union members with IBEW Local 1245 or IBEW Local 47. Many safety-sensitive trade roles fall under company policy or platforms like DISA Global Solutions. For these workers, the recovery path closely mimics official federal protocols.

Non-DOT vs. DOT: Understanding the Difference

Non-DOT workplace safety violations strictly follow your employer’s policies. They do not follow federal transportation mandates. Testing procedures and return-to-duty expectations do mirror standard federal guidelines. However, officials do not report a non-DOT violation to the FMCSA Clearinghouse. You can see this outlined in the official FMCSA Non-DOT Testing Rules.

How to Find a Substance Abuse Professional (SAP)

When a violation occurs, some must work with a qualified Substance Abuse Professional (SAP) to get back to work. You typically find your provider in one of three ways:

  • Company Safety Department List: Your employer provides a short list of local options.
  • Referral Services & Direct Contracts: Your company contracts with a single SAP or a nationwide network.
  • Independent Search: Your employer might cover the evaluation fee, or you may pay out-of-pocket. Either way, you can select your own qualified practitioner. You can find them through search engines or directories like the SAPList Directory.

The 4-Step Return-to-Duty Process

Regardless of how you select your SAP, the official evaluation steps remain standard across the industry:

  1. Initial SAP Evaluation: A thorough clinical assessment evaluates your situation and maps out an action plan.
  2. Education or Treatment Assignment: You complete the required courses, programs, or counseling assigned during your initial evaluation.
  3. Follow-Up Evaluation: A re-assessment verifies that you successfully completed your assigned plan.
  4. Return-to-Duty (RTD) Eligibility: You receive final clearance. This permits your employer to schedule your required Return-to-Duty drug test.

Company Policy and Follow-Up Testing

Your SAP designs a custom follow-up testing schedule upon clearance. Individual company safety standards govern non-DOT rules rather than federal law. Therefore, your employer retains final discretion over how they implement and enforce that follow-up testing plan.
