The Official DOT Rule Supporting This Process

The Federal Motor Carrier Safety Administration explicitly allows this path. This gives you and your employers complete peace of mind:

Can a driver complete a return-to-duty (RTD) test and have a negative RTD test result reported to the Clearinghouse if the driver does not have an employer?

Yes. Check the official FMCSA Clearinghouse FAQ under 49 CFR 382.705(b)(1)(ii). If a driver does not have a current or prospective employer, the driver may register in the Clearinghouse as an owner-operator.

Designating a C/TPA to Clear Your Status

Once registered, the driver can designate a consortium/third-party administrator (C/TPA). This designation serves the limited purpose of completing the RTD process.

The C/TPA can then direct the driver to submit to an RTD test. Finally, they report the negative result to the Clearinghouse on the driver’s behalf. This changes your status to “not prohibited.”

(Note: Your SAP will prescribe a required follow-up testing plan. Your new employer will simply take over and administer this plan once you begin safety-sensitive driving duties).
