There is a dangerous myth circulating among CDL drivers today. Many believe an FMCSA Clearinghouse violation simply vanishes after five years. However, this is not exactly true. A DOT violation fall off can indeed happen after five years. But, there is a massive catch that many drivers miss.
Specifically, that five-year clock only applies if you finish your entire Return-to-Duty (RTD) process. This includes completing the final step of your follow-up testing plan.
Consequently, if you stop working, avoid follow-up tests, or just try waiting out the clock, your violation stays active. It will remain permanently stuck on your record. Furthermore, if you fail to finish your testing plan, that violation waits for you. Even if you step away from driving for ten years, it will still be there when you try to return.
Waiting for a DOT Violation to Fall Off? The “Whichever Is Later” Rule

Then, click on 4. Violations and the RTD Process. Finally, open the Overview of the Return-to-Duty Process. On the third page, above step 6, the FMCSA explains exactly how long your violation remains:
“This information is retained in the Clearinghouse for five years from the date of the violation determination or until the successful completion of the Follow-up testing plan, whichever is later.”
For instance, I recently spoke with a driver who waited exactly five years. He confidently told me he was just waiting for it to fall off. Sadly, because he never started his RTD process with a Substance Abuse Professional (SAP), his violation remained active. Therefore, the only way to clear your record is to formally enter the RTD process with a SAP.
How Your Violation Will Catch Up With You
The FMCSA Clearinghouse officially launched on January 6, 2020. Since then, some drivers have managed to fly under the radar. But, the net is closing fast. Ultimately, here is how an unresolved violation will surface:
- Annual Employer Queries: Employers must run Clearinghouse queries on all active drivers every single year.
- CDL Renewals: State DMVs actively check the database and strip driving privileges for open violations.
- Law Enforcement Stops: A routine traffic stop by a CHP officer can easily trigger a background check.
- Weigh Station Inspections: Standard compliance checks at the scales frequently include Clearinghouse status inquiries.
- DOT Physical Exams: Medical examiners regularly uncover active violations during routine recertification.
In conclusion, do not gamble your livelihood by waiting. A violation will never mysteriously disappear on its own.
