The DOT Return-to-Duty Process

Starting your Return-to-Duty (RTD) process can feel overwhelming, especially when your livelihood depends on getting back behind the wheel. The FMCSA Clearinghouse has specific steps you must follow to clear a violation and regain your “eligible” status.

Here is what you need to know to navigate the process efficiently and get back to work.


1. Accept the Violation and Register

Before you can move forward, you must be registered in the FMCSA Clearinghouse. If you haven’t already, create your account. This is where your violation is recorded and where your progress will be tracked by future employers.

2. Find a Qualified SAP

The most critical step is selecting a Substance Abuse Professional (SAP). You cannot just pick any counselor; they must be DOT-qualified.

  • Your Choice: Under DOT regulations, you have the right to choose your own SAP.
  • The Link: Once you select a provider, you must log into the Clearinghouse and designate them as your SAP so they can upload your initial evaluation and progress up to step 4.

3. Complete the Evaluation and Education/Treatment

Your SAP will conduct an initial evaluation and recommend a plan, which may include education or treatment.

  • Follow-Up: After you complete the requirements, the SAP will perform a remote or face-to-face follow-up evaluation to determine if you are ready for a Return-to-Duty test.

4. The Return-to-Duty Test

Once your SAP marks you as “Eligible” in the system, a prospective or current employer must send you for a Return-to-Duty drug and/or alcohol test. This test must be observed, and the result must be negative before you can perform any safety-sensitive functions.

5. Follow-Up Testing (Step 6)

Even after you’re back on the road, the RTD process isn’t quite over. You will be subject to a MINIMUM of 6 unannounced follow-up tests the first 12 months of employment, up to 60 months, as determined by your SAP.
