2 Ways to Get Your 5th Checkmark in the Clearinghouse

There is a lot of chatter and noise about how to get your 5th checkmark in the Clearinghouse. Some commercial drivers mistakenly believe they can complete this step on their own. However, that rumor is completely false.

According to official Department of Transportation (DOT) rules, you cannot clear your own record. A Substance Abuse Professional (SAP) makes you eligible for this step. However, they only take you up to Step 4. To change your status from “Prohibited” to “Not Prohibited,” you must follow the correct process. Only two legal paths exist to step 5.

Furthermore, ignoring this process triggers a severe penalty. As of November 18, 2024, the DOT and state DMVs are fully integrated. Under this rule change, the DMV automatically downgrades a driver’s CDL if you remain “Prohibited” in the system.

If you want to protect your livelihood, here are the only two ways to get your 5th checkmark in the Clearinghouse:

Path 1: Through Your Current or Future Employer

If you are a company driver, your employer initiates the final step. However, your SAP must clear the way first.

It is important to know that SAP compliance reports are not submitted or uploaded to the Clearinghouse. Instead, your SAP simply enters the date they completed your follow-up evaluation. That single date entry provides your 4th checkmark.

Once you receive that 4th checkmark, you become eligible for the Return-to-Duty (RTD) test. At this point, your employer will schedule that test for you.

Contrary to older rumors, the system does not automatically upload your 5th checkmark when the lab reports a negative result. This step requires deliberate action. Your employer must upload the negative results of the RTD test by the 3rd day of receiving them.

Once your employer enters the results, the Clearinghouse updates instantly. You get the green light and your 5th checkmark right away. Consequently, your commercial driving privileges remain safe and active.

Path 2: Through a Designated C/TPA (For Owner-Operators & Unemployed Drivers)

Independent owner-operators handle compliance differently. Because you do not have a traditional boss, you cannot order your own test. Instead, a designated Consortium/Third-Party Administrator (C/TPA) manages these steps for you.

Important Update: Employee drivers can now register in the Clearinghouse as owner-operators. You can do this strictly to obtain your 5th checkmark. This strategy gets the DMV off your back and reinstates your CDL before renewal time.

However, please be aware: Getting your 5th checkmark does not guarantee an employer will hire you. Company policies and strict insurance rules still apply. These requirements can still impact hiring decisions.

🚨 Warning: Beware of C/TPA Follow-Up Testing Scams

Beware of scam C/TPAs. Some falsely claim they can run your follow-up testing plan while you are unemployed. These scam companies will collect your money and order tests. However, those tests will not count.

By law, you must be gainfully employed behind the wheel of a big rig. Your testing plan only activates when you are actively driving for an employer. The employer you drive for is the only entity authorized to manage your follow-up tests.
